Terms of sale

 

The present terms and conditions of sale are agreed upon by ENDLESS PURE, whose head office is located at 50 bd Stalingrad, Nice, 06300, France, registered with the Trade and Companies Register of Nice under number 931211643, hereinafter referred to as "ENDLESS PURE", and any individual or legal entity wishing to make a purchase via the website endlesspure.com, hereinafter referred to as "the buyer".

Article 1. Purpose

The purpose of these terms of sale is to define the contractual relationship between ENDLESS PURE and the buyer, and the conditions applicable to any purchase made via the website endlesspure.com. Purchasing a product through this site implies the buyer’s unconditional acceptance of these terms of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares that the purchase of products on endlesspure.com is not directly related to their professional activity and is limited to strictly personal use, and that they have full legal capacity to engage under these general sales conditions.

ENDLESS PURE reserves the right to modify these sales conditions at any time in order to comply with any new regulations or to improve the use of the website. The applicable conditions will be those in effect at the date of the order by the buyer.

Article 2. Products

The products offered are those listed on endlesspure.com by ENDLESS PURE, subject to stock availability. ENDLESS PURE reserves the right to change the product selection at any time. Each product is presented on the website with a description of its main features (usage, composition, certification). The photographs are as accurate as possible but are not binding on the seller. The sale of products presented on endlesspure.com is intended for buyers residing in countries within the European Union and the European Economic Area.

Article 3. Prices

The prices listed on the product pages of the online catalog are in Euros (€), including all taxes (TTC). VAT is exempt under article 262 ter, I of the CGI. ENDLESS PURE reserves the right to modify its prices at any time, but the price listed in the catalog on the day of the order will be the only one applicable to the buyer. Prices do not include shipping fees, which are charged in addition to the price of the purchased products based on the total amount of the order.

Article 4. Orders and Payment

Before placing an order, the buyer must create an account on endlesspure.com. The account creation section is accessible directly from the side menu. For each visit, the buyer, if they wish to place an order or access their account (order status, profile, etc.), must log in using their credentials. ENDLESS PURE offers the buyer the option to order and pay for their products in several steps:

• Secure payment via PayPal or credit card (via Shopify Payments): the buyer selects the products they wish to order in the "cart", modifies if necessary (quantities, references, etc.), verifies the shipping address, or enters a new one. Then, the shipping costs are calculated and presented to the buyer, along with the carrier's name. Next, the buyer chooses their preferred payment method: "Shop Pay", "PayPal", ApplePay, GooglePay, or credit card. The next step invites the buyer to review all the information, acknowledge and accept the terms of sale by checking the appropriate box, and then validate their order by clicking "Confirm my order". Finally, the buyer is redirected to a secure interface to enter their account or credit card details. Once the payment is accepted, the order is recorded, and the contract is finalized. Payment is irrevocable, and the order cannot be canceled. In case of fraudulent use, the buyer may request cancellation of the payment, and the amounts paid will be credited back or refunded. The cardholder’s responsibility is not engaged if the fraudulent payment is proven to have been made remotely without the physical use of the card.

By confirming an order, the buyer accepts these terms of sale, acknowledges having full knowledge of them, and waives the right to rely on their own purchase conditions. All provided data and the recorded confirmation serve as proof of the transaction. If the buyer provides an email address, and it is entered correctly, ENDLESS PURE will send an email confirmation of the order.

Article 5. Retention of Title

ENDLESS PURE retains full ownership of the sold products until full payment, including all principal, fees, and taxes, has been received.

Article 6. Right of Withdrawal

According to Article L121-20 of the Consumer Code, the buyer has a period of 14 days from the delivery of their order to exercise their right of withdrawal and return the product for an exchange or refund without penalty, except for return shipping costs. The withdrawal and return conditions are outlined in the Endless Pure Withdrawal and Return Policy.

Article 7. Delivery

Deliveries are made to the address specified on the order form and can only be in the agreed geographic area. Orders are shipped by postal services, with tracking, delivered without a signature. Delivery times are provided as an estimate; if they exceed thirty days from the order, the sales contract can be canceled, and the buyer refunded. ENDLESS PURE may provide the buyer with a tracking number via email. Delivery is made according to the sender’s conditions. Transport risks are borne by the buyer once the items leave ENDLESS PURE's premises. The buyer must inspect the condition of the packaging and the contents upon delivery in the presence of the delivery person. Any damage must be reported to the carrier within three days of delivery.

Article 8. Warranty

All products sold by ENDLESS PURE come with the legal warranty provided under Articles 1641 and following of the Civil Code. In case of non-compliance with a sold product, it may be returned to ENDLESS PURE for an exchange or refund. All claims, exchange, or refund requests must be sent via email to: welcome@endlesspure.com within thirty days of delivery.

Article 9. Liability

ENDLESS PURE, in the process of distance selling, is only bound by a best-efforts obligation. It cannot be held liable for damages resulting from the use of the Internet, such as loss of data, intrusion, virus, service interruption, or other unintentional issues.

Article 10. Intellectual Property

All elements of endlesspure.com are and remain the intellectual and exclusive property of ENDLESS PURE. No one is authorized to reproduce, exploit, or use any part of the site, whether in the form of photos, logos, visuals, or text.

Article 11. Personal Data

ENDLESS PURE commits to maintaining the confidentiality of information provided by the buyer. All information is subject to the provisions of Law No. 78-17 of January 6, 1978. The buyer has the right to access, modify, and delete their personal information at any time by sending a request to: welcome@endlesspure.com.

Article 12. Dispute Resolution

These distance sales terms are governed by French law. Any disputes or claims will be under the jurisdiction of the courts in Nice.
